Years of unfiled returns are fixed through the Streamlined procedure, with the penalties waived.

If you did not know you had to file, you are non-willful. The Streamlined Foreign Offshore Procedures accept three years of returns, six years of FBARs and Form 14653, and waive the failure-to-file, failure-to-pay and FBAR penalties. Most people in this position owe little or nothing.

What the $1,395 covers

The honest part: if your accounts are small and your income was under the exclusion, an FBAR can be filed free through FinCEN and you may need less than this package. I will tell you that on the call.

Questions I get about catching up

Will the IRS come after me for filing late?

Under the Streamlined procedure the penalties are waived when the failure was non-willful. Filing voluntarily, before contact, is what keeps you inside it.

How many years must I file?

Three years of returns and six years of FBARs. Not every year since you left.

Can I still use the Delinquent FBAR procedure instead?

No. The IRS terminated the Delinquent FBAR Submission Procedures around 1 July 2026. Streamlined is now the route for most late filers abroad.

Will I owe tax as well as the filings?

Most people in this position owe little or nothing once the exclusion and the foreign housing exclusion are claimed properly. Any tax that is due for the three years is paid with the submission.

What if the IRS has already written to me?

Then Streamlined is probably closed to you, and the first conversation should be with a lawyer rather than with me. Tell me on the call and I will say so plainly.
